Helly, LLC is a rental and transportation marketplace, offering dumpsters and related services. This Privacy Policy applies to anyone using our websites or mobile apps, whether you’re a registered user (“Member”) or simply visiting (“Visitor”).

Services

This Privacy Policy applies to all of Helly's services, including our websites (www.helly.com), mobile apps, and other platforms. It excludes any service governed by a different privacy policy. Additional details specific to California residents are provided under our California Privacy Requirements.

Helly, LLC is the controller of your personal data when you use our services. Whether you are a Member or Visitor, the collection, use, and sharing of your data will follow this Privacy Policy.

4.1 Data Retention

We keep most of your personal data for as long as your account is active.

We generally retain your personal data as long as you keep your Helly account open or as needed to provide our services. This includes data you or others provided to us and data generated or inferred from your use of our services. Even if you only use our services occasionally, we will retain your information and keep your profile open unless you close your account. In some cases, we may choose to retain certain information (e.g., insights about services use) in a depersonalized or aggregated form.

4.3 Account Closure

We keep some of your data even after you close your account. If you choose to close your Helly account, your personal data will generally stop being visible to others on our services within 24 hours. We typically delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse (e.g., if we have restricted your account), enforce our User Agreement, or fulfill your request to "unsubscribe" from further messages from us. We may retain de-personalized information even after your account has been closed.

Information you have shared with others (e.g., through messages, updates, or group posts) will remain visible after you close your account or delete the information from your own profile or mailbox. We do not control data that others have copied out of our services. Content and ratings or reviews associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in other services (e.g., search engine results) until they refresh their cache.

We implement security safeguards designed to protect your data, such as HTTPS encryption. We regularly monitor our systems for potential vulnerabilities and attacks. However, we cannot guarantee the security of any information that you send us, and there is no assurance that data may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or managerial safeguards.

5.2 Cross-Border Data Transfers

We store and process your data outside of your country. We process data both inside and outside the United States and rely on legally provided mechanisms to transfer data lawfully across borders. Countries where we process data may have laws that are different from, and potentially not as protective as, the laws of your own country.

As a Helly member, you (or your authorized agent) can request a copy of your personal information. Authorized agents will be required to verify their identity, and Helly will require members to confirm, via email from their primary account, that they granted permission to the agent to submit the request. Under the CCPA, you may also request details of how we have collected, used, and shared your personal information over the past 12 months. This includes the categories of personal information we collected and the purposes for doing so, the categories of sources for that information, the categories of third parties with whom we shared it for a business purpose, and the reasons for such sharing.

Under the CCPA, Helly cannot collect new categories of personal information or use them for materially different purposes without first notifying you.

6.2.4 Nondiscrimination for Exercising Your CCPA Rights

The CCPA prohibits businesses from discriminating against you for exercising your rights under the law. Such discrimination may include denying services, charging different prices or rates for services, or providing a different level of quality for goods or services as a result of exercising your rights.

As a Helly member, you may request that we delete your personal information by closing your account or requesting the deletion of specific data. We honor such requests unless an exception applies (e.g., the data is required for legal obligations or for maintaining security).
